It’s that time of year again…
We will be hosting a FREE Health Care Power of Attorney Workshop for college students (and other young adults) next WEDNESDAY, AUGUST 21, 2019 at 7:00 p.m. here at our office.
The purpose of this workshop is to have your adult children, over age 18, discuss and sign Health Care Powers of Attorney.
Here’s the problem:
Once your children turn 18, you have NO LEGAL RIGHT
to talk to their doctors, make medical decisions, etc., unless they give their consent.
This is NOT the same as a HIPAA form they may have signed at their doctor’s office.
If something happens while your child is away (or at home!), such as a physical injury/accident of some sort, a serious medical condition, or a mental health episode, you would have to petition probate court
for the appointment of a guardian. This has happened to my clients, and is not a pleasant experience. It is easily avoidable.
By signing a Health Care Power of Attorney, your child is stating that if they become incapacitated
, they want YOU (or someone else of their choosing) to have access to their medical records, talk to their health care providers, and, if necessary, to make medical decisions.
The workshop should last about an hour. During the workshop, we walk through the entire document, discuss and make the appropriate elections, and sign the documents. We will have staff here to act as witnesses. Your child will leave with the original document, a fully signed copy for you and a copy for their primary care physician.
I hope your son or daughter is able to attend. You are welcome to come with them, but your attendance is not required.
